THE COMMERCIAL DISPUTE RESOLUTION PROCESS
The commercial dispute resolution process will vary according to the individual circumstances of your case. However, certain aspects will be common and we can help you with the following matters:
Pre-Action Advice
If you need pre-action advice prior to issuing or defending court action, we can help you. We will work with you to understand the facts of your case, provide you with an opinion as to your prospects of success and attempt to achieve a commercially advantageous outcome for you.
Issuing Court Action
If you want to issue court action against an individual or an organisation, we can help you. We will prepare your claim form and particulars of claim and issue them at the relevant court.
Defending Court Action
If you want to defend court action that has been issued against you, we can help. We will prepare your defence and file it at the relevant court in order to protect your position and prevent a judgment from being entered against you.
Alternative Dispute Resolution
Alternative dispute resolution is a term used to refer to out of court methods of resolving a dispute. The most common forms of alternative dispute resolution are mediation, adjudication and arbitration and we can help you with each. Dealing with Allocation to the Small Claims Track, Fast Track or Multi-Track
Court cases in England and Wales that are defended are allocated to one of three different pathways: the small claims track, the fast track or the multi-track. We can help you in all of these scenarios.
Dealing with Case Management Directions
When a court has allocated a case to the small claims track, the fast track or the multi-track, it will issue something called case management directions. Case management directions are a list of procedural steps each party must take to prepare a case for a trial.
Disclosure of Documents
Disclosure of documents is the term used to refer to exchange of case documents in a court case. Each party must give the other sight of the documents upon which it intends to rely.
Witness Statement Evidence
The preparation of witness statement evidence is one of the most important tasks in a court case. We can help you to present your witness statement evidence coherently and persuasively in order to give you the greatest chance of success in your case.
Expert Evidence
If your case is of a technical nature and there is a requirement for expert evidence, we will be able to help you identify an expert witness that will be able to provide educated comment on the issues that are in dispute.
Preparing for a Trial

HOW MUCH DOES IT COST?
Our commercial dispute resolution service is based upon a fixed hourly rate of £150.00 plus VAT. We do not charge any set up fees or retainers, there are no commission charges, no percentage charges and no hidden extras.
HOW DO I INSTRUCT YOU?
To access our services, you will need to open an account. You can do this by completing the form on the open an account page of our website. On receipt of your application, we will set you up as a commercial dispute resolution client and then contact you to explain what will happen next.
