What is a charging order?

A charging order is a type of court order allowing a judgment creditor to secure a judgment debt against the assets of a judgment debtor.  In most cases, this involves securing the judgment debt against land (a property or properties) belonging to the judgment debtor.  A charging order can be used to enforce a judgment where the amount outstanding is £1,000.00 or more.

How do you make an application for a charging order?

An application for a charging order is made in the county court or the high court (depending on the amount outstanding) using Form N379.  The court will usually grant an interim charging order on the basis of the information contained within the application and then list the matter for a court hearing, at which it will decide whether to make a final charging order.

How much does it cost to apply for a charging order?

The county court and the high court charge a fee of £110.00 to issue an application for a charging order.  In addition, we charge a fixed fee of £375.00 plus VAT.  An advocate fee of £100.00 plus VAT is also payable.  For further information, please view our Price List.
