WHAT IS AN ORDER TO OBTAIN INFORMATION?
An order to obtain information is a type of court order compelling a judgment debtor to attend court for questioning. The aim is to obtain information about the judgment debtor’s financial circumstances, which might aid a particular method of enforcement and increase the likelihood of success.
HOW DO YOU MAKE AN APPLICATION FOR AN ORDER TO OBTAIN INFORMATION?
An application for an order to obtain information is made in the county court using either Form N316 (if the judgment debtor is an individual) or Form N316A (if the judgment debtor is a company). On granting the application, the court will issue an order for the judgment debtor to attend court. The judgment creditor will be responsible for serving the order on the judgment debtor.
When the order to obtain information has been served on the judgment debtor a hearing at court will take place. This will usually be in the county court that is local to the judgment debtor’s home or commercial premises. During the course of the hearing, the judgment debtor will be cross examined by a court officer (rather than a judge).
HOW MUCH DOES IT COST TO APPLY FOR AN ORDER TO OBTAIN INFORMATION?
The county court charges a fee of £55.00 to issue an order to obtain information. In addition, we charge a fixed fee of £250.00 plus VAT.
