What is a warrant of control?
A warrant of control is a type of court order allowing a judgment creditor to use an enforcement agent (bailiff) to seize and sell a judgment debtor’s goods in order to satisfy a judgment debt. This method of enforcing a judgment is often referred to as ‘execution against goods’. A warrant of control can be used to enforce a judgment where the amount outstanding is less than £600.00.
How do you make an application for a warrant of control?
An application for a warrant of control is made in the county court using Form N323. On granting the application, the court will issue a warrant of control and instruct an enforcement agent (bailiff) to attend at the judgment debtor’s premises.
How much does it cost to apply for a warrant of control?
The county court charges a fee of £77.00 to issue a warrant of control. In addition, we charge a fixed fee, on a sliding scale, according to the value of the debt. For further information, please see our Price List.
What goods can be seized and sold using a warrant of control?
The types of goods that can be seized and sold using a warrant of control depend on whether the judgment debtor is a limited company or an individual debtor. The general rule is that any goods can be seized, provided that they are not ‘exempt goods’. For example, ‘tools of the trade’, in the case of an individual debtor.
How long does a warrant of control last for?
A warrant of control lasts for 12 months from date of issue. It is, however, possible to apply to the county court for it to be renewed where more time is required to enforce a judgment.
