Judgment
JUDGMENT
The third stage of the debt recovery process involves obtaining a judgment against the individual or organisation that owes you money.
WHAT IS A JUDGMENT?
A judgment is a court order requiring an individual or an organisation to pay a sum of money within a certain period of time. Some people refer to a judgment as a CCJ. Unless we receive instructions to the contrary, we will always ask that any judgment we obtain on your behalf is payable immediately, so that you get paid as quickly as possible. The judgment will usually be for the debt you are owed, together with statutory interest, any statutory late payment compensation claimed, plus costs.
HOW IS A JUDGMENT OBTAINED?
A judgment is obtained by submitting a request for judgment to the court. The court will then issue a judgment and send a copy of the judgment to the individual or organisation that owes you money. The existence of the judgment will also be registered at the Registry Trust, the official keeper of the Register of Judgments, Orders and Fines in England and Wales.
DO I NEED A SOLICITOR TO OBTAIN A JUDGMENT?
Strictly speaking, you do not need a solicitor to obtain a judgment. However, using a solicitor may help to avoid mistakes from being made and increase the likelihood of you getting paid.
HOW MUCH DOES IT COST TO OBTAIN A JUDGMENT?
We will obtain a judgment for a fixed fee, determined by the value of the debt you are trying to recover. You can view our sliding scale of fees by viewing our Price List. The cost of obtaining a judgment is recoverable from the individual or organisation that owes you money, subject to your claim being successful, limits on costs set by the Government and your debtor being solvent.
HOW DO I INSTRUCT YOU TO OBTAIN A JUDGMENT?
You can instruct us to obtain a judgment by completing our Judgment & Enforcement Action Form and returning it to: mail@bennettwilliamssolicitors.com.
HOW QUICKLY WILL YOU PROCESS MY REQUEST?
Provided that your instructions are received by 4.00pm, we will process your request the same day. If your instructions are received after 4.00pm, at a weekend or on a bank holiday, we will process your request the next working day.
