What is an attachment of earnings order?
An attachment of earnings order is a type of court order compelling an employer to pay a proportion of a judgment debtor’s salary to a judgment creditor. It is only appropriate where a judgment debtor is an individual in paid employment. An attachment of earnings order can be used to enforce a judgment irrespective of the amount that is outstanding.
How do you make an application for an attachment of earnings order?
An application for an attachment of earnings order is made in the county court using Form N337. It cannot be made in the high court. On issuing the application, the court will send the judgment debtor Form N56, which must be completed and returned to the court within 8 days. If the judgment debtor does not complete and return it, the court will serve Form N61, which must be completed and returned to the court within 8 days. If the judgment debtor does not complete and return it, the court will serve Form N63, requiring him/her to attend a court hearing, at which good reason must be shown as to why the judgment debtor should not be sent to prison of fined up to £250.00.
How much does it cost to apply for an attachment of earnings order?
The county court charges a fee of £110.00 to issue an application for an attachment of earnings order. In addition, we charge a fixed fee of £100.00 plus VAT. For further information, please see our Price List.
